Terms and Conditions

§ 1 Scope, Contracting Party
(1) The following Terms and Conditions (T&C) apply exclusively to all contracts concluded via the online shop at manschettenknoepfe.schwarzer.jewelry (the "Online Shop"), in the version valid at the time of the order.
(2) Your contracting party and the operator of the Online Shop is:

(3) Diverging or additional terms and conditions of the customer are not recognised unless Schwarzer has expressly agreed to them in writing.
(4) These T&C apply to consumers within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) as well as to businesses. Mandatory consumer protection rules are highlighted where applicable.
§ 2 Conclusion of Contract
(1) The presentation of products in the Online Shop does not constitute a legally binding offer but an invitation to the customer to submit an offer.
(2) By clicking the "order with obligation to pay" button in the final step of the checkout, the customer makes a binding offer to conclude a purchase contract for the goods in the shopping cart.
(3) Schwarzer will confirm receipt of the order without delay by email. This confirmation of receipt does not yet constitute acceptance of the offer. The purchase contract is concluded only upon a separate order confirmation or upon dispatch of the goods.
(4) The contract text is stored by Schwarzer. The T&C can be viewed and printed at any time from this page. The order details are additionally sent to the customer by email.
(5) Contracts may be concluded in either German or English.
§ 3 Prices, Shipping Costs
(1) All prices shown in the Online Shop are total prices and include the statutory Austrian value-added tax (currently 20 %).
(2) Shipping within Austria and Germany is free of charge. Shipping costs to other countries are shown separately before the order is completed.
(3) Any customs duties or import taxes for deliveries outside the European Union are borne by the customer.
§ 4 Payment
(1) The payment methods displayed during the checkout process are available (in particular credit card, instant bank transfer, Apple Pay, Google Pay and any other methods offered by our payment service provider).
(2) The purchase price is due on conclusion of the contract.
(3) In the event of late payment, Schwarzer is entitled to charge statutory default interest as well as reasonable reminder and collection costs.
§ 5 Delivery, Delivery Time
(1) Delivery is made to the delivery address specified by the customer during checkout.
(2) Unless stated otherwise, the delivery time within Austria and Germany is 3 – 5 business days from conclusion of the contract. For engraved or otherwise individualised pieces, the delivery time extends to 7 – 10 business days, since these items are made to order.
(3) If a product is temporarily unavailable, Schwarzer will inform the customer without undue delay. In the event of permanent unavailability, Schwarzer is entitled to withdraw from the contract; payments already made will be refunded promptly in such case.
(4) For shipments to consumers, the risk of accidental loss or deterioration of the goods passes to the consumer only upon delivery of the goods.
§ 6 Retention of Title
The delivered goods remain the property of Ferdinand Schwarzer GmbH until the purchase price has been paid in full.
§ 7 Right of Withdrawal for Consumers
Withdrawal Instructions
Consumers within the meaning of § 1 KSchG have a statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG).
Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, takes possession of the goods.

by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the model withdrawal form set out in § 8, but its use is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, Schwarzer will refund all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by Schwarzer), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract.
For such refund, Schwarzer will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged any fees as a result of such refund. Schwarzer may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.
You shall send back the goods or hand them over to Schwarzer without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract. The deadline is met if you send back the goods before the period of 14 days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion of the Right of Withdrawal
Pursuant to § 18 (1) no. 3 FAGG, the right of withdrawal does not apply to contracts for the supply of goods made to the customer's specifications or clearly personalised. This applies in particular to cufflinks with individual engraving. The exclusion of the right of withdrawal is again expressly highlighted to the consumer prior to placing the order.

§ 9 Voluntary 30-Day Return Policy
(1) In addition to the statutory right of withdrawal, Schwarzer voluntarily offers a 30-day return policy from receipt of the goods.
(2) Returns are accepted only if the goods are unused, undamaged and in their complete original packaging (in particular the Schwarzer presentation case).
(3) Engraved or otherwise individualised pieces are excluded from the 30-day return policy (see § 7).
(4) The voluntary return policy does not affect the consumer's statutory right of withdrawal or warranty rights.
§ 10 Warranty
(1) Statutory warranty rights apply pursuant to Austrian law (§§ 922 et seq. ABGB). The warranty period for movable goods is two years from delivery.
(2) Schwarzer cufflinks are crafted from 925 sterling silver in a workshop process. Minor variations in colour, grain or patina are inherent to the material and do not constitute a defect.
(3) Any additional manufacturer's guarantee is only granted if expressly stated for a specific product.
(4) Complaints are to be addressed to fs@schwarzer.jewelry without undue delay after discovery of the defect.
§ 11 Liability
(1) Schwarzer is liable without limitation for damages caused by intent or gross negligence. In cases of slight negligence, Schwarzer is only liable for damages arising from injury to life, body or health and for damages from breach of material contractual obligations; in the latter case, liability is limited to the foreseeable damage typical of the contract.
(2) Liability for lost profits, indirect damages and consequential damages is excluded in cases of slight negligence.
(3) Liability under the Austrian Product Liability Act remains unaffected.
§ 12 Data Protection
Personal data is processed in accordance with the GDPR and the Austrian Data Protection Act. For details, please refer to our Privacy Policy.
§ 13 Online Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution (ODR), accessible at https://ec.europa.eu/consumers/odr.
(2) Schwarzer is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board. However, we always endeavour to resolve complaints directly with our customers – please contact us at fs@schwarzer.jewelry.
§ 14 Final Provisions
(1) These T&C and all contracts concluded between Schwarzer and the customer are governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which the consumer has his or her habitual residence is not thereby withdrawn.
(2) The place of performance is 1050 Vienna. The place of jurisdiction for all disputes arising from or in connection with these T&C is, unless the dispute concerns consumer transactions, the court having subject-matter jurisdiction in 1050 Vienna. For consumers, the mandatory statutory places of jurisdiction apply.
(3) Should individual provisions of these T&C be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected.
